Terms of Service

These Terms of Service ("Terms") govern your use of the r0mance.ai mobile application ("the App"), operated by ZeFactory, Paris, France.

By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By creating an account, you confirm that you meet this age requirement.

2. Description of the Service

r0mance.ai is an AI-powered entertainment application that provides:

• AI character conversations
• Interactive stories
• Interactive games involving text, photo, video, and audio interactions with AI characters
• AI-generated images
• Voice calls with AI characters
• Optional cloud backup and restore of user data

All characters, conversations, and content are fictional and AI-generated. The App is intended for adults only (18+) and for entertainment purposes only. Content may include romantic, flirtatious, and mature themes suited for an adult audience.

3. Account

• You are responsible for maintaining the security of your account
• You must provide a valid email address
• One account per person
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Flames (In-App Currency)

• "Flames" are virtual credits used to interact with AI features
• Flames are purchased through the official app stores (Google Play, Apple App Store)
• Flames are non-refundable once purchased
• Flames have no real-world monetary value and cannot be transferred, traded, or exchanged
• Unused flames do not expire
• We reserve the right to modify flame costs for features at any time

5. User Content

5.1 Photos and Videos

• You may send photos and videos as part of interactive games
• You are solely responsible for the content you submit
• By submitting content, you confirm that you have the right to share it
• Your visual content is processed in real-time and not stored by us

5.2 Prohibited Content

You agree not to use the App to:

• Share content involving minors in any context
• Promote violence or illegal activities
• Harass, threaten, or harm others
• Share content that violates any applicable law
• Attempt to circumvent content safety measures

5.3 Custom Characters and Scenarios

• You may create custom AI characters and scenarios
• Custom content is checked against our content guidelines via automated AI moderation
• Content involving violence, minors, or illegal activities will be rejected

6. AI-Generated Content

• All AI responses, images, and stories are generated by artificial intelligence
• AI-generated content may be inaccurate, inappropriate, or unexpected
• We do not guarantee the quality, accuracy, or appropriateness of AI outputs
• AI-generated images are fictional and do not represent real people
• You understand that AI characters are not real people and interactions are simulated

7. Content Reporting

• You may report conversations, stories, or voice calls if the AI-generated content is inappropriate, violent, or offensive
• Reported session data is sent to our servers for review by our moderation team
• Reports help us improve content safety measures
• We may take action based on reports, including adjusting content moderation rules

8. Backup and Restore

• You may optionally back up your local data to our servers from Settings
• One backup slot per account; new backups overwrite previous ones
• Backups include characters, scenarios, memories, and progression data
• Backups do not include conversations, stories, or voice calls
• Photos are not uploaded in the backup, but photos already present on your device are preserved after a restore
• We do not guarantee backup availability or integrity -- backups are provided as a convenience
• You may delete your backup at any time
• Upon account deletion, backups are permanently removed
• We are not responsible for data loss due to backup or restore failures

9. Intellectual Property

• The App, its design, code, and branding are owned by ZeFactory
• AI-generated content created during your use of the App is provided for your personal use only
• You may not redistribute, sell, or commercially exploit AI-generated content
• Custom characters and scenarios you create remain your intellectual property

10. Limitations of Liability

• The App is provided "as is" without warranties of any kind
• We are not liable for any damages arising from your use of the App
• We are not responsible for AI-generated content that may be offensive or inappropriate
• We do not guarantee uninterrupted or error-free service
• We are not liable for any loss of locally stored data (conversations, images, game progress)
• We are not liable for data loss resulting from backup or restore operations, including but not limited to data corruption, migration failures, or incomplete restores

11. Content Moderation

• We implement content safety measures to prevent harmful content
• AI characters will refuse requests related to minors, violence, and illegal activities
• AI-generated images will never contain sexually explicit content
• Custom characters and scenarios are moderated automatically before use
• We reserve the right to modify content safety measures at any time

12. Termination

• You may delete your account at any time by contacting us
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your account data (including server-side backups) will be deleted
• Locally stored content on your device is your responsibility

13. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance. Material changes will be communicated through the App.

14. Governing Law

These Terms are governed by the laws of France. Any disputes will be subject to the exclusive jurisdiction of the courts of Paris, France.
